Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you and His Flock (doing business as Flock) concerning your access to and use of the Flock platform, including our website at https://www.hisflock.org and our mobile application.

By accessing or using Flock, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you are prohibited from using or accessing the Services.

You must be at least 18 years old to use Flock. By using our Services, you represent and warrant that you are 18 years of age or older.

1. User Accounts

To access certain features of Flock, you must create an account. When creating your account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Accept all responsibility for activity under your account
  • Notify us immediately of any unauthorized access

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion, especially if we believe you have violated these Terms.

2. Subscriptions and Payments

Flock Club Membership

Flock offers a premium subscription called "Flock Club" for $7.99 per month. Flock Club members receive access to:

  • Community feed and interactions (comments, likes)
  • Curated music and playlists
  • Exclusive events and content
  • Premium features as they are released

Billing and Renewal

All payments are processed securely through Stripe. By subscribing to Flock Club, you agree that:

  • Your subscription will automatically renew each month
  • You will be charged the subscription fee on a recurring basis
  • You can cancel at any time through your account settings
  • Cancellation will take effect at the end of your current billing period
  • No refunds will be provided for partial months

Price Changes

We reserve the right to change subscription prices at any time. We will provide at least 30 days' notice of any price changes. Continued use of Flock Club after a price change constitutes your agreement to pay the new price.

3. User Content

Flock allows you to create, post, and share content including journal entries, comments, and community posts ("User Content"). By posting User Content, you:

  • Retain ownership of your content
  • Grant Flock a license to use, store, and display your content as necessary to provide the Services
  • Represent that you have the right to post the content
  • Agree that your content does not violate any third-party rights

Private vs. Public Content

Private journal entries are visible only to you and are not shared with other users or publicly displayed.

Community posts and comments (available to Flock Club members) are visible to other Flock Club members. By posting to the community, you acknowledge that your content will be visible to others.

4. Community Guidelines

Flock is a faith-based community built on respect, encouragement, and authenticity. When participating in the community, you agree to:

  • Be respectful and kind to other members
  • Encourage and uplift others in their faith journey
  • Share authentically while respecting boundaries
  • Maintain confidentiality of personal information shared by others
  • Report content that violates these guidelines

We reserve the right to remove any content or ban users who violate these community standards.

Zero Tolerance Policy

Flock has zero tolerance for objectionable content and abusive behavior. The following will result in immediate content removal and account termination:

  • Harassment, bullying, threats, or intimidation
  • Hate speech or discrimination based on race, religion, gender, sexual orientation, disability, or any protected characteristic
  • Sexually explicit, pornographic, or obscene content
  • Violence, graphic content, or promotion of self-harm
  • Illegal activities or promotion of dangerous acts
  • Spam, scams, or fraudulent content

Reporting & Enforcement

If you encounter content or behavior that violates our policies:

  • Report: Use the "Report" button on any post to flag inappropriate content
  • Block: Use the "Block User" button to prevent abusive users from interacting with you
  • 24-Hour Response: We review all reports within 24 hours and take immediate action

Users who violate these policies will have their content removed and their accounts permanently banned. Serious violations may be reported to law enforcement.

5. Prohibited Activities

You may not access or use Flock for any purpose other than that for which we make it available. Prohibited activities include:

  • Harassing, bullying, or threatening other users
  • Posting hateful, discriminatory, or offensive content
  • Sharing explicit sexual content or nudity
  • Impersonating another person or entity
  • Spamming or soliciting users for commercial purposes
  • Attempting to hack, disrupt, or damage the platform
  • Scraping or data mining user information
  • Using automated systems or bots
  • Violating any applicable laws or regulations

6. Intellectual Property Rights

The Flock platform, including its design, functionality, features, text, graphics, logos, and software, is owned by His Flock and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from any part of Flock without our express written permission.

The "Flock" name and logo are trademarks of His Flock. You may not use our trademarks without prior written consent.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. By using Flock, you consent to our collection and use of personal data as outlined in the Privacy Policy.

8. Disclaimers

Not a Substitute for Professional Help: Flock is a journaling and community platform, not a substitute for professional medical, psychological, or spiritual counseling. If you are experiencing a mental health crisis, please contact a licensed professional or crisis hotline immediately.

No Medical Advice: Any health, wellness, or spiritual content provided through Flock is for informational purposes only and should not be considered professional advice.

Platform Availability: We do not guarantee that Flock will be available at all times or error-free. We may modify, suspend, or discontinue any aspect of the Services at any time without notice.

9. Limitation of Liability

To the fullest extent permitted by law, His Flock and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Flock.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months prior to the event giving rise to liability, or $100, whichever is greater.

10. Termination

You may cancel your account at any time through your account settings or by contacting us at andrea@hisflock.org.

We reserve the right to suspend or terminate your access to Flock at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

Upon termination, your right to use Flock will immediately cease. You may request a copy of your data before your account is deleted.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of Flock after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using Flock.
